SAUCE PIZZA AND WINE
REWARDS PROGRAM TERMS OF USE
Effective Date: 7/29/2024
These Rewards Program Terms of Use (“Terms”) apply to your access to, and participation in, the Sauce Pizza and Wine Rewards Program (“Rewards Program”), which is operated by BBQ Holdings, Inc. dba Sauce Pizza and Wine (“we,” “us,” “our,” or “Sauce Pizza and Wine”). These Terms incorporate by reference our Sauce Pizza and Wine Privacy Policy, Mobile Application End User License Agreement, and Mobile App Privacy Policy, as well as all other applicable terms, conditions, limitations, and requirements. These Terms, together with the terms related to any promotional offers provided to you for use with the Rewards Program, constitute the entire agreement between you and Sauce Pizza and Wine related to this Rewards Program. By enrolling, and continuing to use the Rewards Program, you accept these terms, conditions, limitations, and requirements.
About the Rewards Program
Sauce Pizza and Wine offers the Rewards Program to reward and thank our loyal restaurant customers for patronizing our business. The Rewards Program is available to enrolled members at participating Sauce Pizza and Wine restaurants in the United States. Rewards accumulated under the Rewards Program are promotional and have no cash value. There are no membership fees associated with the Rewards Program. Your rewards and account are personal to you and may not be sold, transferred or assigned to, or shared with, family, friends or others, or used by you for any commercial purpose. You may have only one (1) Rewards Account that is personal to you.
Eligibility
You may enroll in the Rewards Program if you: (1) are a legal resident of the United States; (2) are at least 13 years of age at the time you enroll; and (3) have an active, valid e-mail address. No corporations, partnerships, limited liability companies, or other legal entities can participate in the Rewards Program. Persons employed by Sauce Pizza and Wine or its affiliates are prohibited from participation in the Rewards Program beyond initial discovery and familiarization. The Rewards Program is not targeted towards, nor intended for use by, anyone under the age of 13. If you are between the ages of 13 and 18, you may only the Rewards Program under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
Enrollment and Rewards Account
You can enroll in the Rewards Program and create a Rewards Program account (“Rewards Account”) in one of the following ways:
- Download the Sauce Pizza and Wine Mobile Application (“App”) on the App Store or Google Play;
- Visit the Sauce Pizza and Wine website located at https://www.saucepizzaandwine.com/rewards; or
You will be required to provide the following information when you sign-up for a Rewards Account: first name, last name, email address, phone number, and preferred restaurant. You may also create a Rewards Account by logging into your Facebook account.
As a part of the Rewards Program, Sauce Pizza and Wine will send you transactional, informational, and promotional messages and/or offers. These communications may happen in the form of push notifications through the App, email, and/or any other ways you may have selected when you enrolled in the Rewards Program. If your contact information changes, or if you wish to change your contact information or the method by which we send you messages, please log into your Rewards Account and update your contact information or preferences.
Earning Points and Rewards
You will earn and receive points toward a Reward by making qualified purchases at participating Sauce Pizza and Wine restaurants and: (a) placing an order directly from your App; (b) scanning your App at the point of purchase; or (c) uploading a photo of your receipt in the App within seven (7) days of your purchase.
You will earn one (1) point per purchase of $1.00 per visit. You will not earn a point towards a Reward if you spend less than a total of $0.99 in one transaction. The maximum number of points earned per transaction is 100 points. Further, you may only earn points on one (1) purchase per each twelve (12) hour period. Please be advised that points cannot be earned on catering orders or orders placed through third parties (e.g., Uber Eats, DoorDash). At certain locations, points cannot be earned on alcoholic beverages. Points will also not be earned on purchases of gift cards. You can track the status of your points and Rewards by logging into your Rewards Account and accessing your history. Points expire after 365 days. Dollars spent prior to 8/6/2024 will not be retroactively awarded points.
Points may be redeemed for complimentary items (each, a “Reward”) and participating Sauce Pizza and Wine locations as follows:
- By accumulating 35 points in your Rewards Account, you will earn a free non-alcoholic beverage.
- By accumulating 55 points in your Rewards Account, you will earn a free ‘Light Bite’ or dessert.
- By accumulating 75 points in your Rewards Account, you will earn a $5 reward.
- By accumulating 100 points in your Rewards Account, you will earn a free pizza, pasta, or salad.
Rewards may be redeemed: (a) in store by scanning your App or providing your phone number at the point of purchase, (b) on orders placed directly through https://saucepizzaandwine.olo.com/, or (c) on orders placed through the App. Rewards cannot be redeemed on catering orders or orders placed through third parties (e.g., Uber Eats, DoorDash). At certain locations, Rewards cannot be redeemed on alcoholic beverages. If any Rewards are believed to have been sold, exchanged, or obtained fraudulently, or issued to someone other than the member, those Rewards will be void and will not be honored.
Additional Rewards Program Terms
Without notice to you, Sauce Pizza and Wine reserves the right to suspend or terminate your Rewards Account and/or your participation in the Rewards Program if we determine in our sole discretion that you have violated these Terms, you have more than one (1) Rewards Account, or that the use of your account is unauthorized, deceptive, fraudulent or otherwise unlawful. In the event that your participation in the Rewards Program is terminated, all accrued points and Rewards in your account are void.
Without notice to you, Sauce Pizza and Wine may, in its sole discretion, suspend, cancel, or combine Rewards Accounts that appear to be duplicative, and may refuse to allow you to re-enroll in the Rewards Program. Sauce Pizza and Wine also reserves the right to “unregister” and make ineligible for the Rewards Program any Rewards Account that has been inactive for 365 days. Inactive is defined as no Rewards earned during the 365-day period. In the event that your Rewards Account is unregistered or rendered inactive, all accrued points and Rewards in your account are void.
Sauce Pizza and Wine has the right at any time, with or without giving you prior notice, to:
- end or cancel the Rewards Program and/or any specific Reward;
- change any Reward or other Rewards Program benefit we offer;
- change the requirements for earning a particular Reward;
- change the time you have in which to earn a particular Reward; and/or
- change any other feature of the Rewards Program.
If we end the Rewards Program, points or Rewards you have earned but not used will expire on the end date, and you may not redeem any Rewards or use any points after the end date.
Governing Law, Venue and Jurisdiction
These Terms shall be shall be governed by the laws of the State of Minnesota without regard to conflict of law principles. Any claim or dispute related to the Rewards Program or under these Terms must be instituted within one (1) year after the claim arose (if multiple claims, from the date the first claim arose), or be forever waived and barred. You agree that you will bring any claims in, and submit to the exclusive jurisdiction of, the state and federal courts located in the County of Hennepin, in the State of Minnesota.
Miscellaneous Terms
No waiver of these terms by us shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure by us to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
